If you own a trade mark may bring an action for the domain name that has someone else?

If you register a trademark, and someone else already has the trademark word as a domain name (+ theword. com) you can file a claim for the domain name? Does it matter that the domain name holder domain has been registered your domain name before registering your trademark? (I know I seem to be seeking legal advice but juest need to have an idea about of the situation - I am a law student myself.)
